• Payment processing for photography services

2.2 Photography Services

Through our platform, we facilitate access to various photography services including:

• Professional interior and exterior property photography
• Virtual tours and 360-degree property walkthroughs
• Drone photography and aerial property shots
• HDR photography for optimal lighting and exposure
• Floor plan creation and architectural drawings
• Virtual staging services for vacant properties
• 3D virtual tours for immersive property exploration
• Video tours and cinematic property presentations
• Commercial property photography services

3.1 Account Creation

To use our Services, you must create an account by providing accurate, current, and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Providing valid contact information and keeping it updated

3.2 Professional Requirements

Users representing real estate professionals must:

• Hold a valid real estate license where required by law
• Comply with all applicable real estate regulations
• Maintain professional insurance coverage as required
• Adhere to ethical standards and fair housing laws

3.3 Account Suspension and Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a risk to our platform or users.

4.1 Order Placement

When placing an order through our platform:

• You warrant that you have the authority to order services for the property
• All property information provided must be accurate and complete
• You are responsible for obtaining necessary permissions for photography
• Orders are subject to photographer availability and scheduling

4.2 Property Access

You agree to:

• Provide accurate lockbox information when applicable
• Ensure safe access to the property for photography services
• Inform us of any access restrictions or special requirements
• Coordinate with property owners or tenants as needed

4.3 Order Modifications and Cancellations

Order changes or cancellations are subject to our cancellation policy and may incur fees based on the timing and nature of the change.

5.1 Pricing and Payment

All prices are displayed in USD and are subject to change. Payment is due:

• 50% deposit at time of booking
• Remaining balance upon completion of services
• For rush orders, full payment may be required upfront
• Additional fees may apply for rescheduling or special requests

5.2 Payment Methods

We accept various payment methods including:

• Major credit and debit cards
• ACH bank transfers
• Digital wallets (Apple Pay, Google Pay)
• Agency invoicing for approved accounts

5.3 Refunds and Disputes

Refund requests are handled according to our refund policy. Payment disputes should be directed to our billing department within 30 days of the transaction.

LYSTO owns all rights to the platform, including:

• Software, algorithms, and technical infrastructure
• Trademarks, logos, and branding elements
• Content created by LYSTO staff and contractors
• Platform design and user interface elements

6.2 Photography Content

Photography content rights are governed by agreements between:

• Photographers and real estate agents
• Platform usage terms for digital delivery
• MLS requirements and copyright laws
• Licensing agreements for commercial use

6.3 User-Generated Content

You retain rights to content you provide, but grant us a license to use it for service provision and platform operation.

7.1 Prohibited Uses

You agree not to:

• Use the platform for illegal or unauthorized purposes
• Interfere with platform security or functionality
• Upload malicious code or harmful content
• Violate intellectual property rights of others
• Engage in fraudulent or deceptive practices
• Harass, abuse, or harm other users
• Provide false or misleading information

7.2 Compliance Requirements

You must comply with all applicable laws, including:

• Real estate licensing and disclosure requirements
• Fair housing and anti-discrimination laws
• Privacy and data protection regulations
• Copyright and intellectual property laws
• Drone operation and aviation regulations

8.1 Service Availability

While we strive for high availability, we do not guarantee:

• Uninterrupted access to our services
• Error-free operation of the platform
• Immediate response to technical issues
• Availability of specific photographers in all locations

8.2 Limitations of Liability

Our liability is limited to the amount paid for services. We are not liable for:

• Indirect, incidental, or consequential damages
• Loss of profits or business opportunities
• Damage to property during photography services
• Third-party actions or photographer conduct

9.1 Photographer Responsibilities

Photography service providers agree to:

• Provide services in a professional and timely manner
• Comply with all applicable laws and regulations
• Maintain appropriate insurance coverage
• Deliver high-quality work meeting industry standards
• Respect client property and privacy

9.2 Platform Fees

Photographers acknowledge that LYSTO charges platform fees for:

• Booking facilitation and coordination
• Payment processing and protection
• Marketing and lead generation
• Platform maintenance and development

11.1 Termination by User

You may terminate your account at any time by contacting us or using the account closure feature in your settings.

11.2 Termination by LYSTO

We may terminate or suspend your account if:

• You violate these Terms or applicable laws
• Your account shows suspicious or fraudulent activity
• You engage in behavior that harms our platform or users
• We discontinue the service or specific features

11.3 Effect of Termination

Upon termination, your right to use our Services ceases immediately. We will retain your data for a reasonable period as required by law or business needs.

12.1 Informal Resolution

We encourage you to contact us first to resolve any disputes. Most issues can be resolved through our customer support team.

12.2 Binding Arbitration

Any disputes not resolved informally will be subject to binding arbitration in accordance with the rules of the American Arbitration Association.
